This policy tells you how we use and protect your personal information.  Please read the entire document in its entirety for a complete description of our Privacy Policy and prior to your agreement with this policy. 

1.   Scope. 

This privacy policy describes how we handle your personal information for our “Site” (defined as www. MondoDesigner.com, and all associated sites and services linked, networked, or associated with and to www.MondoDesigner.com by Mondo Power, Inc. (“Mondo”), its subsidiaries and affiliates including  Mondo  and user's own usernamed.MondoDesigner.com sites around the world) and the “Services” (defined as  Mondo , the Site, and all services and products provided by or through  Mondo , its subsidiaries, affiliates, and/or the Site that, among other things, permit you to purchase license for downloads of digital content---such as sound recordings---under certain terms and conditions as set forth in our Terms of Service and Use Agreement available through our Site.  By accepting the Mondo Privacy Policy and the Terms of Service and Use Agreement in customer registration you expressly consent to our collection, storage, use, and disclosure of your personal information as described in this Privacy Policy.  This Privacy Policy is effective upon acceptance for new users and is otherwise effective on June 1, 2008. 

2.   Collection. 

You can browse the Site without telling us who you are or revealing any personal information about yourself.  Once you give us your personal information, you are not anonymous to us.  If you choose to provide us with personal information, you consent to transfer and storage of that information to our servers located in the United States. We may collect and store the following information: 

·          Email addresses, physical contact information; 

·          Financial information, such as credit card or bank card account numbers until your transaction is completed, or as an on-going part of your file, if you so request by checking the appropriate box during the checkout phase or in your registration or sign-up; 

·          Transactional information based on your activities on the Site (such as buying, listening, sign-up of customers, as well as content that you may generate that relates to your account); 

·          Shipping, billing and other information you provide to purchase or ship an item; 

·          Community discussions, product reviews, chats, dispute resolution, correspondence through the Site, and correspondence sent to us; 

·          Computer sign-on data, statistics, page views, download history, traffic to and from the Site, ad data, other information, including IP addresses and standard web log information; and  

·          Supplemental information from third parties (for example, if you incur a debt to  Mondo, we reserve the right to conduct a credit check by obtaining additional information about you from a credit bureau, as permitted by law.  As another example, if the information you provide about yourself cannot be verified, we may as you to send us additional information (such as a driver’s license number, a credit card statement and/or a recent utility bill or other information confirming your address and identity), or to answer additional questions online or over the phone to help verify your information.) 

3.  Marketing. 

We don’t sell or rent your personal information to third parties for their marketing, advertising, or other purposes without your explicit consent.  We may, however, combine your general non-personal informational statistics with information and/or general non-personal informational statistics we collect from other companies and/or other people using the Site to create general demographic information that does not personally identify you in order to personally improve the Site and our Services or to sell, rent, or share with third parties inside our outside Mondo.  If you do not want to receive marketing or promotional materials from Mondo, simply indicate your preference when you log on to the Site or in your Personal Account Information or by following the directions within any marketing or promotional email we may send at your request. 

4.   Use. 

Our primary purpose in collecting personal information is provide you with a smooth, efficient, enjoyable, and customized experience and to ensure your reasonable safety when using the Site or Services.   

You agree that we may use your personal information to: 

·          Provide the services and customer support you request; 

·          Resolve disputes, collect fees, pay commissions or royalties, and troubleshoot problems; 

·          Prevent potential prohibited or illegal activities, and to enforce our Terms of Service and Use Agreement; 

·          Customize, measure, improve or add to our Services and the Site’s content and layout; 

·          Tell you about targeted marketing, service updates, and promotional offers based on your indicated preferences; and compare information for accuracy, and verify it with third parties as is necessary to conduct and efficiently transact our Services and the business of the Site. 

5.  Disclosure of Your Information. 

We may disclose your personal information to respond to legal requirements, enforce our policies, and respond to claims that a posting, communication, or other content or action violates the rights of others, or protect anyone’s rights, property, or safety. We may also share your information with: 

·          Authorized employees of Mondo  in order for them to perform any assigned duties related to the legal use of your information and in providing service to you. 

·          Members of our affiliated companies and/or subsidiaries to help detect and prevent potentially illegal acts and provide join services (our affiliated companies and/or subsidiaries will only market to users of the Site and Services who so request); 

·          Service providers under contract with us who help with our business operations (such as fraud investigators, bill collection, and affiliate and rewards programs); 

·          Other third parties to whom you explicitly ask us to send your information (or about whom you are otherwise explicitly notified and consent to when using a specific Service); 

·          Law enforcement or other governmental officials, in response to a verified request relating to a criminal investigation or alleged illegal activity (in such events we will disclose name, city, state, telephone number, email address,  Mondo ID, Service and Site history, fraud complaints and such other information as required by law); 

·          Our own employees and/or contractors under confidentiality agreements, as we in our sole discretion, deem necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity (in such events we will disclose name, street address, city, state, zip code, country, phone number, email, and company name); 

·          The Grassroots Community genealogy that precedes you (in such cases we will disclose name, street address, city, state, zip code, country, phone number, email, company name, sales and purchasing history, and sign-up history); 

·          Any business entities we plan to acquire, merge with, and/or be acquired by (such combination occur, we will require the new combined entity to follow this Privacy Policy with respect to your personal information.  If your personal information is to be use contrary to this policy, you will receive prior notice). 

Without limiting the foregoing, in an effort to respect your privacy and our ability to keep the  Mondo Community free individuals with malicious or harmful intent, we will not otherwise disclose your personal information to law enforcement, other government officials, or other third parties without a subpoena, court  order or substantially similar legal procedure, except when we believe, in good faith, that the disclosure of information is necessary to prevent imminent physical harm or financial loss or to report suspected illegal activity. 

5.   Activity Associated with  Mondo IDs. 

Your Mondo ID is displayed throughout the Site and is therefore available to the public.  All of your activities on the Site will be traceable to your Mondo ID.  Other people can see you’re front end of your community sites, web sites, and any team environments you create that invite others, your text from your Mondo websites, your feedback, ratings, associated comments, your blogs or discussion trees, any activity in which you publicly participate through the Site or Service, and so on.  Notices are sent to other Mondo Community members regarding suspicious activity and policy violations on the Site or in regard to the Services and refer to the  Mondo ID and the specific violations and/or offenses associated with such activities.  Therefore, if you associate your name with your  Mondo ID, the people to whom you have revealed your name to will be able to personally identify your  Mondo-related activities. 

6.   Using Information from  Mondo  

Our Site and Services enable you to share personal and financial information with others in order to complete transactions.  You should not assume that other community members will follow your own preferred privacy policy or the Mondo Privacy Policy.  We encourage you to disclose your privacy practices and respect the privacy practices and requests of others in all such intra-and-inter-community interactions and transactions.  We cannot guarantee the privacy or security of any information and therefore we encourage you to evaluate the privacy and security policies of anyone you may be directly dealing with within or related to Mondo or its communities or activities before entering into any transactions or sharing any information with them.  To help protect your privacy we allow only limited access to other users’ contact, shipping, and financial information in order to facilitate your transactions.  When users are involved in a transaction, they may, by the nature of the transaction or otherwise, have access to each other’s name, Mondo ID, email address, and other contact and shipping information.  In all cases, you must give other users a chance to remove themselves from your database and a chance to review what information you have collected about them. You agree to use user information only for: 

·           Mondo transaction-related purposes that are not unsolicited commercial messages; 

·          Using Services offered through the Site; 

·          Other services that a user expressly chooses. 

7.   Cookies. 

We do not currently use cookies (small files placed on your hard drive).  In the event we ever do use cookies they will not be used to store personal information about you.  You should be aware that in the future it is possible that you may encounter cookies from third parties on certain pages affiliated with the Site or its Services that we do not control.  (For example a glimpse of another web page or a link to another web page may require the use of cookies in order for you to interact with that page or link).  You therefore should carefully monitor your own preferred policy with regard to cookies on your computer and by way of your own security software or firewall. 

8.   No spam, phishing, spyware, or spoofing. 

 Mondo  and its users and communities do not tolerate spam (or other forms of mass emailing without the receiver’s express consent), phishing (bogus emails designed to allow you to secretively or fraudulently gather personal information about others), spyware, or spoofing (pretending to be or to represent a person, entity, service, or product you are not authorized to represent).  You are not licensed to add other  Mondo  customers, or users to your email list without their express consent.  spyware, or spoofing, please forward the email to violation-alert@MondoDesigner.com This email address is being protected from spam bots, you need Javascript enabled to view it .  You may not use our communication tools to send spam, to spoof, phish, or otherwise send any content that would violate our Terms of Service and Use Agreement. We do filter and automatically scan messages before they are sent for viruses and other illegal or prohibited content but may not permanently store email messages sent through these tools.  If you send an email to an email address that is not registered within a Mondo community, we do not permanently store that email or use that email address for any marketing purposes.  We also do not rent or sell these email addresses. 

9.   Account Protection. 

Your password is the key to your account.  Use unique numbers and letters and do not disclose your  Mondo  password to anyone.  You may consider changing your password several times a year or more frequently, if you desire, your confidence in its confidentiality.  If you do choose to share your password or personal information with others, remember that you are responsible for all actions taken in the name of your account, regardless of the actual user.  If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf by others.  Therefore, if your password has been compromised for any reason, you should immediately notify Mondo and change your password. 

10.  Accessing, Reviewing, and Changing Your Personal Information. 

You can see, review and change most of your personal information by logging into the Site.  Generally we will not modify your personal information remotely because it is very difficult to verify your actual identity remotely.  You must promptly update your personal information if it changes or becomes inaccurate.  Once you make a public posting (for example a review, a blog, or a discussion board comment), you may not change it or remove it.  Upon your request, we will close your account and remove your personal information from view as soon as is reasonably possible, based on your account activity and in accordance with applicable law.  We do retain personal information from closed accounts in order to comply with law, prevent fraud, collect frees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Terms of Service and Use Agreement, and take any other actions otherwise permitted by law. 

11.  Security. 

Your information is store on our servers located in the United States.  We treat data as an asset that must be protected and use a variety of tools (industry standard firewealls, encryption, password protection, physical security, etc.) to protect your personal information against unauthorized access and disclosure.  However, as you may know, third parties may unlawfully intercept or access transmission or private communications, and other users may abuse or misuse your personal information that they collect from the Site.  Therefore, although we work very hard to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private. 

12.  Third Parties. 

Except as otherwise expressly included in this Privacy Policy, this document addresses only the use and disclosure of information we collect from you.  If you disclose your information to others, whether they be visitors, members, or customers to our Site or other sites throughout the Internet, different rules apply to their use or disclosure of the information you disclose to them.  Since  Mondo  does not control the privacy policies of third parties, you are subject to the privacy policies of those third parties.  We encourage you to ask questions before you disclose your personal information to others. 

13.  General. 

We may amend this Privacy Policy at any time by posting the amended terms on the Site.  All amended terms automatically take effect 30 days after they are initially posted on the Site.  In addition, we will notify you in accordance with the notification email address and in accordance with your stated preferences as listed in the Personal Information section of your account.
